1. What ZAVENO is

ZAVENO is a digital platform for training, recovery, nutrition and tracking, operated by Manolo Cicero Aranda, with an address at Calle 18 #90 por 19, colonia Itzimná, C.P. 97100, Mérida, Yucatán, México ("ZAVENO", "we", "us"). Contact: hola@zaveno.app.

By creating a profile you accept these terms and the privacy notice (zaveno.app/privacy.html).

2. ZAVENO is not a medical service

• ZAVENO is a training and wellness tool. It is not a medical device: it does not diagnose, prevent, monitor or treat diseases, and it does not replace care from health professionals.
• The metrics (Readiness, Load, Engine, zones, percentiles) and the adjustment suggestions are for guidance only. They are offered to you when you start training and are never applied without your acceptance.
• If you have pain, fever, an injury or a health condition, consult a professional before training.
• Meal plans are prescribed by your nutritionist or a professional with a professional license (General Health Law, or Ley General de Salud, Article 79). ZAVENO stores them, reminds you of them and tracks your adherence; it does not generate diets.
• The supplementation you log is your decision or your professional's. ZAVENO does not sell, recommend or promote products.

3. Who can use it

You must be 18 years of age or older and reside in Mexico. You agree to provide truthful information in your profile.

4. Your account

• You sign in with passkeys, with no password; other devices are linked with a temporary code. Take care of the devices where you store your passkey.
• You are responsible for what is done from your account and for what you share (your calendar link, Gym Bro sessions, your AI connections).
• You can delete your account whenever you want.

5. Your data and your content

• Your data belongs to you. You give us permission to store and process it solely to provide you with the service, as explained in the privacy notice.
• We do not sell your data or use it for advertising.
• You can export it and delete it.

6. Coaches and professionals

• If you share your profile with a coach, you choose with whom and you can stop sharing at any time.
• The coach suggests and you decide: nothing the coach suggests changes your plan without your acceptance.
• Coaches and professionals who use ZAVENO commit to confidentiality, to not sharing your data further, and to understanding that ZAVENO is not a clinical record.

7. Integrations and AI assistants

• Wearables and services (WHOOP, intervals.icu, Health Connect, Bluetooth sensors, Spotify): you connect them yourself, with the authorization you give on their page or on your phone. Their data is displayed with their name and attribution, and is subject to their own terms. Some controls (for example, controlling music) require a paid account with that service.
• HYROX results: you can import your own result by pasting the link to its official page. Import only your own results; the results website applies its own terms.
• Your AI assistant (Claude, ChatGPT or another): you connect it yourself, with the permissions you choose on ZAVENO's permission screen, and you disconnect it whenever you want. ZAVENO does not sell AI or control your assistant's responses; that provider applies its own terms and policy.
• Review what your assistant saves in ZAVENO: the routines and plans it creates are your responsibility.

8. Acceptable use

Do not use ZAVENO to access other people's accounts, harm the platform, extract data by automated means outside the permitted integrations, or publish illegal or offensive content.

9. Prices, charges and cancellation (when applicable)

ZAVENO is currently free. If it charges in the future:

• Total price shown, taxes included, before you pay.
• Subscriptions: we will clearly tell you the frequency, the amount and the date of each automatic charge, and we will only charge with your express consent; if there is automatic renewal, we will notify you at least 5 calendar days in advance and you may cancel without penalty.
• Immediate cancellation from the app, at any time.
• Right of withdrawal: you may cancel the purchase within the following 5 business days and we will refund what you paid.
• No additional charges or services that you have not accepted.

10. Availability and changes to the service

• We work to keep ZAVENO available, but there may be interruptions due to maintenance or failures. While it is in the testing phase, some features may change or fail.
• We may improve or change features. If a change affects what you pay, we will notify you beforehand and you may cancel.
• We will not unilaterally modify these terms to the detriment of your rights. Changes are published with a date and version, and we notify you of them in the app.

11. Liability

• Training involves physical risks. You decide when, how much and how you train.
• ZAVENO is liable for what corresponds to it under Mexican law. Nothing in these terms limits your rights as a consumer.

12. Intellectual property and open source

• The ZAVENO brand, its emblem and its identity belong to their owner.
• The application is based on open-source software under the AGPL-3.0 license. You can request, free of charge, the source code corresponding to the version you use by writing to hola@zaveno.app.
• Third-party exercise images are used in accordance with their licenses.

13. Governing law and complaints

• The laws of Mexico apply.
• For any complaint, write to us at hola@zaveno.app; we respond within a maximum of 5 business days.
• You may also turn to the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO).
• For judicial matters, the courts of Mérida, Yucatán have jurisdiction, without prejudice to your right to go to the courts of your place of residence.
